The Paris Agreement<\/strong> (French: Accord de Paris<\/em>), often referred to as the Paris Accords<\/strong> or the Paris Climate Accords<\/strong>, is an international treaty on climate change<\/a>. Adopted in 2015, the agreement covers climate change mitigation<\/a>, adaptation<\/a>, and finance<\/a>. The Paris Agreement was negotiated by 196 parties<\/a> at the 2015 United Nations Climate Change Conference<\/a> near Paris<\/a>, France. As of February 2023, 195 members of the United Nations Framework Convention on Climate Change<\/a> (UNFCCC) are parties to the agreement. Of the three UNFCCC member states which have not ratified<\/a> the agreement, the only major emitter is Iran<\/a>. The United States withdrew<\/a> from the agreement in 2020, but rejoined in 2021.
\u3010\u53c2\u8003\u8bd1\u6587\u3011\u5df4\u9ece\u534f\u5b9a\uff08\u6cd5\u8bed\uff1aAccord de Paris\uff09\uff0c\u901a\u5e38\u79f0\u4e3a\u5df4\u9ece\u534f\u8bae\u6216\u5df4\u9ece\u6c14\u5019\u534f\u5b9a\uff0c\u662f\u4e00\u9879\u5173\u4e8e\u6c14\u5019\u53d8\u5316\u7684\u56fd\u9645\u6761\u7ea6\u3002\u8be5\u534f\u5b9a\u4e8e2015\u5e74\u901a\u8fc7\uff0c\u6db5\u76d6\u4e86\u6c14\u5019\u53d8\u5316\u51cf\u7f13\u3001\u9002\u5e94\u548c\u878d\u8d44\u7b49\u65b9\u9762\u3002\u5df4\u9ece\u534f\u5b9a\u7531196\u4e2a\u7f14\u7ea6\u65b9\u57282015\u5e74\u6cd5\u56fd\u5df4\u9ece\u9644\u8fd1\u7684\u8054\u5408\u56fd\u6c14\u5019\u53d8\u5316\u5927\u4f1a\u4e0a\u8c08\u5224\u8fbe\u6210\u3002\u622a\u81f32023\u5e742\u6708\uff0c\u8054\u5408\u56fd\u6c14\u5019\u53d8\u5316\u6846\u67b6\u516c\u7ea6\uff08UNFCCC\uff09\u7684195\u4e2a\u6210\u5458\u56fd\u52a0\u5165\u4e86\u8be5\u534f\u5b9a\u3002\u5728\u5c1a\u672a\u6279\u51c6\u8be5\u534f\u5b9a\u7684\u4e09\u4e2aUNFCCC\u6210\u5458\u56fd\u4e2d\uff0c\u552f\u4e00\u4e3b\u8981\u7684\u6392\u653e\u56fd\u662f\u4f0a\u6717\u3002\u7f8e\u56fd\u57282020\u5e74\u9000\u51fa\u4e86\u8be5\u534f\u5b9a\uff0c\u4f46\u57282021\u5e74\u91cd\u65b0\u52a0\u5165\u3002<\/p>\n\n\n\n

The Paris Agreement’s long-term temperature goal is to keep the rise in mean global temperature to well below 2 \u00b0C (3.6 \u00b0F) above pre-industrial levels, and preferably limit the increase to 1.5 \u00b0C (2.7 \u00b0F), recognizing that this would substantially reduce the effects of climate change<\/a>. To achieve this goal, emissions should be reduced as soon as possible and reach net zero<\/a> by the middle of the 21st century.[3]<\/a> To stay below 1.5 \u00b0C of global warming, emissions need to be cut by roughly 50% by 2030. This is an aggregate of each country’s nationally determined contributions<\/a>.[4]<\/a>

It aims to help countries adapt to climate change effects, and mobilize enough finance. Under the agreement, each country must determine, plan, and regularly report<\/a> on its contributions. No mechanism forces a country to set specific emissions targets<\/a>, but each target should go beyond previous targets. In contrast to the 1997 Kyoto Protocol<\/a>, the distinction between developed and developing countries is blurred, so that the latter also have to submit plans for emission reductions.

The Paris Agreement was opened for signature on 22 April 2016 (Earth Day<\/a>) at a ceremony inside the UN Headquarters<\/a> in New York<\/a>. After the European Union<\/a> ratified the agreement, sufficient countries had ratified the agreement responsible for enough of the world’s greenhouse gases<\/a> for the agreement to enter into force on 4 November 2016.
\u3010\u53c2\u8003\u8bd1\u6587\u3011\u5df4\u9ece\u534f\u5b9a\u4e8e2016\u5e744\u670822\u65e5\uff08\u5730\u7403\u65e5\uff09\u5728\u7ebd\u7ea6\u8054\u5408\u56fd\u603b\u90e8\u5185\u7684\u4eea\u5f0f\u4e0a\u5f00\u653e\u7b7e\u7f72\u3002\u5728\u6b27\u76df\u6279\u51c6\u8be5\u534f\u5b9a\u540e\uff0c\u8db3\u591f\u6570\u91cf\u7684\u56fd\u5bb6\u6279\u51c6\u4e86\u8be5\u534f\u5b9a\uff0c\u8fd9\u4e9b\u56fd\u5bb6\u8d1f\u8d23\u4e16\u754c\u4e0a\u8db3\u591f\u7684\u6e29\u5ba4\u6c14\u4f53\u6392\u653e\u91cf\uff0c\u4f7f\u5f97\u8be5\u534f\u5b9a\u4e8e2016\u5e7411\u67084\u65e5\u751f\u6548\u3002<\/p>\n\n\n\n

The agreement was lauded by world leaders, but criticized as insufficiently binding by some environmentalists and analysts. There is debate about the effectiveness of the agreement. While current pledges<\/a> under the Paris Agreement are insufficient for reaching the set temperature goals, there is a mechanism of increased ambition<\/a>. The Paris Agreement has been successfully used in climate litigation<\/a> forcing countries and an oil company to strengthen climate action.[5]<\/a>[6]<\/a>
\u3010\u53c2\u8003\u8bd1\u6587\u3011\u4e16\u754c\u9886\u5bfc\u4eba\u5bf9\u8fd9\u9879\u534f\u8bae\u8868\u793a\u8d5e\u8d4f\uff0c\u4f46\u4e00\u4e9b\u73af\u4fdd\u4eba\u58eb\u548c\u5206\u6790\u4eba\u58eb\u6279\u8bc4\u5b83\u7684\u7ea6\u675f\u529b\u4e0d\u591f\u3002\u5bf9\u4e8e\u534f\u8bae\u7684\u6548\u529b\u5b58\u5728\u4e89\u8bae\u3002\u5c3d\u7ba1\u300a\u5df4\u9ece\u534f\u5b9a\u300b\u4e0b\u7684\u5f53\u524d\u627f\u8bfa\u4e0d\u8db3\u4ee5\u5b9e\u73b0\u8bbe\u5b9a\u7684\u6e29\u5ea6\u76ee\u6807\uff0c\u4f46\u5b58\u5728\u4e00\u79cd\u589e\u52a0\u96c4\u5fc3\u7684\u673a\u5236\u3002\u300a\u5df4\u9ece\u534f\u5b9a\u300b\u5df2\u6210\u529f\u5728\u6c14\u5019\u8bc9\u8bbc\u4e2d\u88ab\u4f7f\u7528\uff0c\u8feb\u4f7f\u5404\u56fd\u548c\u4e00\u5bb6\u77f3\u6cb9\u516c\u53f8\u52a0\u5f3a\u6c14\u5019\u884c\u52a8\u3002<\/p>\n\n\n

The aim of the agreement, as described in Article 2, is to have a stronger response to the danger of climate change; it seeks to enhance the implementation of the United Nations Framework Convention on Climate Change through:[7]<\/a>

The UN Framework Convention on Climate Change<\/a> (UNFCCC), adopted at the 1992 Earth Summit<\/a> is one of the first international treaties on the topic. It stipulates that parties should meet regularly to address climate change, at the Conference of Parties<\/a> or COP. It forms the foundation to future climate agreements.[8]<\/a>
\u3010\u53c2\u8003\u8bd1\u6587\u3011\u8054\u5408\u56fd\u6c14\u5019\u53d8\u5316\u6846\u67b6\u516c\u7ea6\uff08UNFCCC\uff09\uff0c\u662f\u57281992\u5e74\u5730\u7403\u5cf0\u4f1a\u4e0a\u901a\u8fc7\u7684\uff0c\u5b83\u662f\u5173\u4e8e\u8fd9\u4e00\u4e3b\u9898\u7684\u9996\u6279\u56fd\u9645\u6761\u7ea6\u4e4b\u4e00\u3002\u5b83\u89c4\u5b9a\u7f14\u7ea6\u65b9\u5e94\u5b9a\u671f\u5728\u7f14\u7ea6\u65b9\u4f1a\u8bae\u6216COP\u4e0a\u4f1a\u6664\uff0c\u4ee5\u5e94\u5bf9\u6c14\u5019\u53d8\u5316\u3002\u5b83\u4e3a\u672a\u6765\u7684\u6c14\u5019\u534f\u8bae\u5960\u5b9a\u4e86\u57fa\u7840\u3002[8]<\/p>\n\n\n\n

The Kyoto Protocol<\/a>, adopted in 1997, regulated greenhouse gas<\/a> reductions for a limited set of countries from 2008 to 2012. The protocol was extended until 2020 with the Doha Amendment in 2012.[9]<\/a> The United States decided not to ratify the Protocol, mainly because of its legally-binding nature. This, and distributional conflict, led to failures of subsequent international climate negotiations. The 2009 negotiations were intended to produce a successor treaty of Kyoto, but the negotiations collapsed and the resulting Copenhagen Accord<\/a> was not legally binding and did not get adopted universally.[10]<\/a>[11]<\/a>

The Accord did lay the framework for bottom-up approach of the Paris Agreement.[10]<\/a> Under the leadership of UNFCCC executive secretary Christiana Figueres<\/a>, negotiation regained momentum after Copenhagen’s failure.[12]<\/a> During the 2011 United Nations Climate Change Conference<\/a>, the Durban Platform<\/a> was established to negotiate a legal instrument governing climate change mitigation<\/a> measures from 2020. The platform had a mandate to be informed by the Fifth Assessment Report of the IPCC and the work of the subsidiary bodies of the UNFCCC.[13]<\/a> The resulting agreement was to be adopted in 2015.[14]<\/a>

Negotiations in Paris took place over a two-week span, and continued throughout the three final nights.[15]<\/a>[16]<\/a> Various drafts and proposals had been debated and streamlined in the preceding year.[17]<\/a> According to one commentator two ways in which the French increased the likelihood of success were: firstly to ensure that Intended Nationally Determined Contributions<\/a> (INDCs) were completed before the start of the negotiations, and secondly to invite leaders just for the beginning of the conference.[18]<\/a>

The negotiations almost failed because of a single word when the US legal team realized at the last minute that “shall” had been approved, rather than “should”, meaning that developed countries would have been legally obliged to cut emissions: the French solved the problem by changing it as a “typographical error”.[19]<\/a> At the conclusion of COP21 (the 21st meeting of the Conference of the Parties), on 12 December 2015, the final wording of the Paris Agreement was adopted by consensus by the 195 UNFCCC participating member states and the European Union.[20]<\/a> Nicaragua<\/a> indicated they had wanted to object to the adoption as they denounced the weakness of the agreement, but were not given a chance.[21]<\/a>[22]<\/a> In the agreement the members promised to reduce their carbon output<\/a> “as soon as possible” and to do their best to keep global warming “to well below 2 degrees C<\/a>” (3.6 \u00b0F).[23]<\/a>

2.3 \u7b7e\u7f72\u548c\u751f\u6548 | Signing and entry into force<\/h3>\n\n\n\n

The Paris Agreement was open for signature by states and regional economic integration organizations that are parties to the UNFCCC (the convention) from 22 April 2016 to 21 April 2017 at the UN Headquarters in New York.[24]<\/a> Signing of the agreement is the first step towards ratification<\/a>, but it is possible to accede<\/a> to the agreement without signing.[25]<\/a> It binds parties to not act in contravention of the goal of the treaty.[26]<\/a> On 1 April 2016, the United States and China, which represent almost 40% of global emissions confirmed they would sign the Paris Climate Agreement.[27]<\/a>[28]<\/a> The agreement was signed by 175 parties (174 states and the European Union) on the first day it was opened for signature.[29]<\/a>[30]<\/a> As of March 2021, 194 states and the European Union have signed the agreement.[1]<\/a>

The agreement would enter into force (and thus become fully effective) if 55 countries that produce at least 55% of the world’s greenhouse gas emissions<\/a> (according to a list produced in 2015)[31]<\/a> ratify or otherwise join the treaty.[32]<\/a>[25]<\/a> Alternative ways to join the treaty are acceptance, approval or accession. The first two are typically used when a head of state is not necessary to bind a country to a treaty, whereas the latter typically happens when a country joins a treaty already in force.[33]<\/a> After ratification by the European Union, the agreement obtained enough parties to enter into effect on 4 November 2016.[34]<\/a>

Both the EU and its member states are individually responsible for ratifying the Paris Agreement. A strong preference was reported that the EU and its 28 member states ratify at the same time to ensure that they do not engage themselves to fulfilling obligations that strictly belong to the other,[35]<\/a> and there were fears by observers that disagreement over each member state’s share of the EU-wide reduction target, as well as Britain’s vote to leave the EU<\/a> might delay the Paris pact.[36]<\/a> However, the EU deposited its instruments of ratification on 5 October 2016, along with seven EU member states.[36]<\/a>

The EU and 194 states, totalling over 98% of anthropogenic emissions<\/a>, have ratified or acceded to the agreement.[1]<\/a>[37]<\/a>[38]<\/a> The only countries which have not ratified are some greenhouse gas emitters in the Middle East<\/a>: Iran with 2% of the world total being the largest.[39]<\/a> Libya<\/a> and Yemen<\/a> have also not ratified the agreement<\/a>.[1]<\/a> Eritrea is the latest country to ratify the agreement, on 7 February 2023.

Article 28 enables parties to withdraw from the agreement after sending a withdrawal notification to the depositary<\/a>. Notice can be given no earlier than three years after the agreement goes into force for the country. Withdrawal is effective one year after the depositary is notified.[40]<\/a>

On 4 August 2017, the Trump administration<\/a> delivered an official notice to the United Nations<\/a> that the United States, the second largest emitter of greenhouse gases after China,[41]<\/a> intended to withdraw from the Paris Agreement as soon as it was eligible to do so.[42]<\/a> The notice of withdrawal could not be submitted until the agreement was in force for three years for the US, on 4 November 2019.[43]<\/a>[44]<\/a> The U.S. government deposited the notification with the Secretary General of the United Nations and officially withdrew one year later on 4 November 2020.[45]<\/a>[46]<\/a> President Joe Biden<\/a> signed an executive order on his first day in office, 20 January 2021, to re-admit the United States into the Paris Agreement.[47]<\/a>[48]<\/a> Following the 30-day period set by Article 21.3, the U.S. was readmitted to the agreement.[49]<\/a>[50]<\/a> United States Climate Envoy<\/a> John Kerry took part in virtual events, saying that the US would “earn its way back” into legitimacy in the Paris process.[51]<\/a> United Nations Secretary-General<\/a> Ant\u00f3nio Guterres<\/a> welcomed the return of the United States as restoring the “missing link that weakened the whole”.[51]<\/a>

The Paris Agreement is a short agreement with 16 introductory paragraphs and 29 articles. It contains procedural articles (covering, for example, the criteria for its entry into force) and operational articles (covering, for example, mitigation, adaptation<\/a> and finance). It is a binding agreement, but many of its articles do not imply obligations or are there to facilitate international collaboration.[52]<\/a> It covers most greenhouse gas emissions, but does not apply to international aviation and shipping, which fall under the responsibility of the International Civil Aviation Organization<\/a> and the International Maritime Organization<\/a>, respectively.[53]<\/a>

4.1 \u7ed3\u6784 | Structure<\/h3>\n\n\n\n

The Paris Agreement has been described as having a bottom-up structure, as its core pledge and review<\/a> mechanism allows nations to set their own nationally determined contributions (NDCs), rather than having targets imposed top down.[54]<\/a>[55]<\/a> Unlike its predecessor, the Kyoto Protocol, which sets commitment targets that have legal force, the Paris Agreement, with its emphasis on consensus building<\/a>, allows for voluntary and nationally determined targets.[56]<\/a> The specific climate goals are thus politically encouraged, rather than legally bound. Only the processes governing the reporting and review of these goals are mandated under international law<\/a>. This structure is especially notable for the United States\u2014because there are no legal mitigation or finance targets, the agreement is considered an “executive agreement rather than a treaty”. Because the UNFCCC treaty of 1992 received the consent of the US Senate, this new agreement does not require further legislation.[56]<\/a>

Another key difference between the Paris Agreement and the Kyoto Protocol is their scope. The Kyoto Protocol differentiated between Annex-I<\/a>, richer countries with a historical responsibility for climate change, and non-Annex-I countries, but this division is blurred in the Paris Agreement as all parties are required to submit emissions reduction plans.[57]<\/a> The Paris Agreement still emphasizes the principle of Common but Differentiated Responsibility and Respective Capabilities<\/a>\u2014the acknowledgement that different nations have different capacities and duties to climate action\u2014but it does not provide a specific division between developed and developing nations.[57]<\/a>

Countries determine themselves what contributions they should make to achieve the aims of the treaty. As such, these plans are called nationally determined contributions<\/a><\/em> (NDCs).[59]<\/a> Article 3 requires NDCs to be “ambitious efforts” towards “achieving the purpose of this Agreement” and to “represent a progression over time”.[59]<\/a> The contributions should be set every five years and are to be registered by the UNFCCC Secretariat<\/a>.[60]<\/a> Each further ambition should be more ambitious than the previous one, known as the principle of progression<\/em>.[61]<\/a> Countries can cooperate and pool their nationally determined contributions. The Intended Nationally Determined Contributions pledged during the 2015 Climate Change Conference<\/a> are converted to NDCs when a country ratifies the Paris Agreement, unless they submit an update.[62]<\/a>[63]<\/a>

The Paris Agreement does not prescribe the exact nature of the NDCs. At a minimum, they should contain mitigation provisions, but they may also contain pledges on adaptation, finance, technology transfer<\/a>, capacity building<\/a> and transparency.[64]<\/a> Some of the pledges in the NDCs are unconditional, but others are conditional on outside factors such as getting finance and technical support, the ambition from other parties or the details of rules of the Paris Agreement that are yet to be set. Most NDCs have a conditional component.[65]<\/a>

While the NDCs themselves are not binding, the procedures surrounding them are. These procedures include the obligation to prepare, communicate and maintain successive NDCs, set a new one every five years, and provide information about the implementation.[66]<\/a> There is no mechanism to force[67]<\/a> a country to set a NDC target by a specific date, nor to meet their targets.[68]<\/a>[69]<\/a> There will be only a name and shame<\/a> system[70]<\/a> or as J\u00e1nos P\u00e1sztor<\/a>, the former U.N. assistant secretary-general on climate change, stated, a “name and encourage” plan.[71]<\/a>

4.3 \u5168\u7403\u5e93\u5b58\u6838\u67e5 | Global stocktake<\/h3>\n\n\n\n

Under the Paris Agreement, countries must increase their ambition every five years. To facilitate this, the agreement established the Global Stocktake<\/a>, which assesses progress, with the first evaluation in 2023. The outcome is to be used as input for new nationally determined contributions of parties.[72]<\/a> The Talanoa Dialogue<\/a> in 2018 was seen as an example for the global stocktake.[73]<\/a> After a year of discussion, a report was published and there was a call for action, but countries did not increase ambition afterwards.[74]<\/a>

The stocktake works as part of the Paris Agreement’s effort to create a “ratcheting up” of ambition in emissions cuts. Because analysts agreed in 2014 that the NDCs would not limit rising temperatures below 2 \u00b0C, the global stocktake reconvenes parties to assess how their new NDCs must evolve so that they continually reflect a country’s “highest possible ambition”.[75]<\/a> While ratcheting up the ambition of NDCs is a major aim of the global stocktake, it assesses efforts beyond mitigation. The five-year reviews will also evaluate adaptation, climate finance<\/a> provisions, and technology development and transfer.[75]<\/a>

Article 6 has been flagged as containing some of the key provisions of the Paris Agreement.[76]<\/a> Broadly, it outlines the cooperative approaches<\/a> that parties can take in achieving their nationally determined carbon emissions reductions. In doing so, it helps establish the Paris Agreement as a framework for a global carbon market.[77]<\/a> Article 6 is the only important part of the agreement yet to be resolved; negotiations in 2019<\/a> did not produce a result.[78]<\/a> The topic was settled during the 2021 COP26 in Glasgow<\/a>. A mechanism, the “corresponding adjustment”, was established to avoid double counting for emission offsets.[79]<\/a>

Some specific outcomes of the elevated attention to adaptation financing in Paris include the G7 countries<\/a>‘ announcement to provide US$420 million for climate risk insurance<\/a>, and the launching of a Climate Risk and Early Warning Systems (CREWS) Initiative.[101]<\/a> The largest donors to multilateral climate funds, which includes the Green Climate Fund, are the United States, the United Kingdom, Japan, Germany, France and Sweden.[102]<\/a>

The Paris Agreement recognizes loss and damage<\/a> of this kind.[103]<\/a> Loss and damage can stem from extreme weather events<\/a>, or from slow-onset events such as the loss of land to sea level rise<\/a> for low-lying islands.[56]<\/a> Previous climate agreements classified loss and damage as a subset of adaptation.[103]<\/a>

The push to address loss and damage as a distinct issue in the Paris Agreement came from the Alliance of Small Island States<\/a> and the Least Developed Countries, whose economies and livelihoods are most vulnerable to the negative effects of climate change.[56]<\/a> The Warsaw Mechanism<\/a>, established two years earlier during COP19 and set to expire in 2016, categorizes loss and damage as a subset of adaptation, which was unpopular with many countries. It is recognized as a separate pillar of the Paris Agreement.[104]<\/a> The United States argued against this, possibly worried that classifying the issue as separate from adaptation would create yet another climate finance provision.[56]<\/a> In the end, the agreement calls for “averting, minimizing, and addressing loss and damage”[7]<\/a> but specifies that it cannot be used as the basis for liability. The agreement adopts the Warsaw Mechanism, an institution that will attempt to address questions about how to classify, address, and share responsibility for loss.[103]<\/a>

Both developed and developing nations must report every two years on their mitigation efforts, and all parties will be subject to technical and peer review.[105]<\/a>

While the enhanced transparency framework is universal, the framework is meant to provide “built-in flexibility” to distinguish between developed and developing countries’ capacities. The Paris Agreement has provisions for an enhanced framework for capacity building, recognizes the varying circumstances of countries, and notes that the technical expert review for each country consider that country’s specific capacity for reporting.[106]<\/a> Parties to the agreement send their first Biennial Transparency Report (BTR), and greenhouse gas inventory<\/a> figures to the UNFCCC by 2024 and every two years after that. Developed countries submit their first BTR in 2022 and inventories annually from that year.[107]<\/a> The agreement also develops a Capacity-Building Initiative for Transparency to assist developing countries in building the necessary institutions<\/a> and processes for compliance.[106]<\/a>

The Paris Agreement has become a focal point of climate change litigation. One of the first major cases in this area was State of the Netherlands v. Urgenda Foundation<\/a><\/em>, which was raised against the Netherlands’ government after it had reduced its planned emissions reductions goal for 2030 prior to the Paris Agreement. After an initial ruling against the government in 2015 that required it to maintain its planned reduction, the decision was upheld on appeals through the Supreme Court of the Netherlands<\/a> in 2019, ruling that the Dutch government failed to uphold human rights under Dutch law and the European Convention on Human Rights<\/a> by lowering its emission targets.[5]<\/a> The 2 \u00b0C temperature target of the Paris Agreement provided part of the judgement’s legal basis.[108]<\/a> The agreement, whose goals are enshrined in German law, also formed part of the argumentation in Neubauer et al. v. Germany<\/a><\/em>, where the court ordered Germany to reconsider its climate targets.[109]<\/a>

The Paris Agreement is implemented via national policy. It would involve improvements to energy efficiency<\/a> to decrease the energy intensity<\/a> of the global economy. Implementation also requires fossil fuel burning to be cut back and the share of sustainable energy<\/a> to grow rapidly. Emissions are being reduced rapidly in the electricity sector, but not in the building, transport and heating sector. Some industries are difficult to decarbonize, and for those carbon dioxide removal<\/a> may be necessary to achieve net zero emissions<\/a>.[114]<\/a> In a report released in 2022 the IPCC promotes the need for innovation and technological changes in combination with consumption and production behavioral changes to meet Paris Agreement objectives.[115]<\/a>

To stay below 1.5 \u00b0C of global warming, emissions need to be cut by roughly 50% by 2030. This is an aggregate of each country’s nationally determined contributions<\/a>. By mid-century, CO2 emissions would need to be cut to zero, and total greenhouse gases would need to be net zero<\/a> just after mid-century.[4]<\/a>

There are barriers to implementing the agreement. Some countries struggle to attract the finance necessary for investments in decarbonization. Climate finance is fragmented, further complicating investments. Another issue is the lack of capabilities in government and other institutions to implement policy. Clean technology<\/a> and knowledge<\/a> is often not transferred to countries or places that need it.[114]<\/a> In December 2020, the former chair of the COP 21, Laurent Fabius<\/a>, argued that the implementation of the Paris Agreement could be bolstered by the adoption of a Global Pact for the Environment<\/a>.[116]<\/a> The latter would define the environmental rights and duties of states, individuals and businesses.[117]<\/a>

The agreement was lauded by French President Fran\u00e7ois Hollande<\/a>, UN Secretary General Ban Ki-moon<\/a> and Christiana Figueres<\/a>, Executive Secretary of the UNFCCC.[122]<\/a> The president of Brazil, Dilma Rousseff<\/a>, called the agreement “balanced and long-lasting”,[123]<\/a> and India’s prime minister Narendra Modi<\/a> commended the agreement’s climate justice<\/a>.[124]<\/a>[125]<\/a> When the agreement achieved the required signatures in October 2016, US President Barack Obama<\/a> said that “Even if we meet every target, we will only get to part of where we need to go.”[126]<\/a> He also stated “this agreement will help delay or avoid some of the worst consequences of climate change [and] will help other nations ratchet down their emissions over time.”[126]<\/a>

Some environmentalists<\/a> and analysts reacted cautiously, acknowledging the “spirit of Paris” in bringing together countries, but expressing less optimism about the pace of climate mitigation and how much the agreement could do for poorer countries.[127]<\/a> James Hansen<\/a>, a former NASA scientist and leading climate change expert, voiced anger that most of the agreement consists of “promises” or aims and not firm commitments and called the Paris talks a fraud with “no action, just promises”.[128]<\/a> Criticism of the agreement from those arguing against climate action has been diffuse, which may be due to the weakness of the agreement. This type of criticism typically focusses on national sovereignty and ineffectiveness of international action.

The effectiveness of the Paris Agreement to reach its climate goals is under debate, with most experts saying it is insufficient for its more ambitious goal of keeping global temperature rise under 1.5 \u00b0C.[129]<\/a>[130]<\/a> Many of the exact provisions of the Paris Agreement have yet to be straightened out, so that it may be too early to judge effectiveness.[129]<\/a> According to the 2020 United Nations Environment Programme (UNEP<\/a>), with the current climate commitments of the Paris Agreement, global mean temperatures will likely rise by more than 3 \u00b0C by the end of the 21st century. Newer net zero<\/a> commitments were not included in the Nationally Determined Contributions<\/a>, and may bring down temperatures a further 0.5 \u00b0C.[131]<\/a>

With initial pledges by countries inadequate, faster and more expensive future mitigation would be needed to still reach the targets.[132]<\/a> Furthermore, there is a gap between pledges by countries in their NDCs and implementation of these pledges; one third of the emission gap between the lowest-costs and actual reductions in emissions would be closed by implementing existing pledges.[133]<\/a> A pair of studies in Nature<\/a><\/em> found that as of 2017 none of the major industrialized nations were implementing the policies they had pledged, and none met their pledged emission reduction targets,[134]<\/a> and even if they had, the sum of all member pledges (as of 2016) would not keep global temperature rise “well below 2 \u00b0C”.[135]<\/a>[136]<\/a>

In 2021, a study using a probabilistic<\/a> model concluded that the rates of emissions reductions would have to increase by 80% beyond NDCs<\/a> to likely meet the 2 \u00b0C upper target of the Paris Agreement, that the probabilities of major emitters meeting their NDCs without such an increase is very low.
